§ 15-7. Weeds, grass, trash, nuisance—Misdemeanor.

  • (a)

    It shall be unlawful for any person to create or maintain a nuisance as defined in 15-3. In addition to any abatement procedures authorized by code, any owner or occupant of the lot or tract of land who creates or maintains a nuisance shall be deemed guilty of a misdemeanor.

    (b)

    In addition to requirements by section 15-3, it shall be the duty of the owners of any lot, tract or parcel of ground within the City of Carthage, and every person in possession, charge or control of any such lot, tract or parcel of ground, to keep the same free and clear from the rank growth of weeds and of all trash and brush, to the curb line of the street to which said lot, tract, or parcel of ground is adjacent, and to the middle line of any alley upon which such lot, tract or parcel of ground may abut or adjoin.

    (c)

    The owner, owners, or occupant of the land shall be responsible for any nuisance, and all shall be individually subject to prosecution.

    (d)

    No notice is required to the owner or occupant of property prior to initiating prosecution for such violation.

    (e)

    Each day on which such violation continues shall constitute a separate offense(s).

    (f)

    The provisions of this section are separate and independent of any other abatement procedures.
