§ 6-102. Amendments.

  • The International Property Maintenance Code/2006 is amended and revised in the following respects:

    Section 101.1 (page 1) Insert: The City of Carthage

    Insert: Section 106.3.1 (page 3) Remedies: If a person violates these codes or if a notice of violation is not complied with within the time specified by the code official, the code official may cause a municipal court summons to be issued and the code official may also request the City Attorney to institute the appropriate legal proceeding to obtain an injunction to restrain, correct or abate such violation or to require removal or termination of the unlawful use of the building or structure in violation of the provisions of these codes or of any order or direction made pursuant thereto.

    Section 106.4 (page 3) Insert, after the first sentence: Any person upon conviction of a violation Shall be subject to a fine of not more than $500.00

    Section 109.1 (page 4) Delete Entire Section, Insert New Section: Imminent Danger. When, in the opinion of the code Official, there is imminent danger of failure or collapse of a building, structure or tree which endangers life, or when any structure, part of a structure or tree has fallen and life is endangered by the occupation of the structure or exterior premises, or when there is actual or potential danger to the building occupants or those in the proximity of any structure because of explosives, explosive fumes or vapors or the presence of toxic fumes, gases or materials, or operation of defective or dangerous equipment, or a dangerous tree, the code official is hereby authorized and empowered to order and require the occupants to vacate the premises forthwith. The code official shall cause to be posted at each entrance to such structure or exterior premises a notice reading as follows: "This Structure Or Exterior Premises Is Unsafe and Its Occupancy Or Use Has Been Prohibited By The Code Official." Its shall be unlawful for any person to enter such structure or exterior premises except for the purpose of securing the structure, making the required repairs, demolishing the structure, removing a tree or removing the hazardous condition.

    Section 110.1 (page 4) Insert: , damaged by fire" after the word dilapidated. Delete: "two" Insert: "one"

    Section 111.2 (page 5) Change: Board of Appeals number from 3 to 5

    Section 202 (page 7) Insert: Hazardous trees shall mean any tree with severe structural defects or splits or is determined to be dead or is so diseased that the same will threaten public safety or property.

    Section 302.4 (page 9) Insert: 8" height for weed and plant overgrowth

    Section 302.4.1 (page 9) Insert: Property free of hazardous trees.

    Section 304.14 (page 10) Delete: "During the period from [Date] to [Date]"

    Section 304.18.1 (page 11) Delete: in its entirety

    Section 602.3 (page 17) Insert: September 1 to May 31

    Section 602.4 (page 17) Insert: September 1, to May 31

    Section 604.1 (page 17) Insert: "and in accordance with the 2008 National Electric Code" at the end of the paragraph

    Section 604.2 (page 17—18) Delete: "60" and Insert "100" amperes

    Section 605.1 (page 18) Insert: "in compliance with the 2008 National Electric Code" at the end of the paragraph.
