§ 24-193. Applications and acceptance.

  • (a)

    No person desiring to extend a sewer main shall be obligated to make application under this division. Any person can extend a sewer main by complying with the applicable federal, state, and city codes and regulations, and paying the entire cost of said extension without the possibility of recoupment provided by this division.

    (b)

    Additional sewer mains and sewer main extensions may be connected to any extension made hereunder, but such connection shall not entitle the original applicant for extension to a refund from the pro rata sewer fund.

    (c)

    That portion of a sewer main extension which shall be subject to recoupment shall be measured from the point of attachment to the existing sewer main to the property line of the applicant. Any portion of a sewer main extension that is within the applicant's property is not subject to recoupment. Any portion of a sewer main extension that is outside of the corporate limits of the city shall not be subject to recoupment.

    (d)

    Any person desiring to extend any existing sewer main and desiring the benefits and obligations of this division shall make written application therefore to the city engineer on forms provided by the city engineer. Said application shall be accompanied by an initial fee, as established by the city and shown on the application form, which is to be nonrefundable, and which shall be paid to the city engineering department. All costs incurred in making this application shall be borne by the applicant and are not subject to recoupment. All applications shall provide the following information:

    (1)

    Name and address of the applicant.

    (2)

    Use of the sewer main extension (i.e., commercial, residential, or industrial).

    (3)

    Copy of the platted subdivision or survey of the tract or lot to be served shall be attached to the application.

    (4)

    Cost estimate for said sewer extension prepared by a Missouri Registered Professional Engineer (P.E.). Estimate shall reflect state and/or federal wage rates when applicable.

    (5)

    The application shall state the means by which the sewer extension will be constructed, either under a contract between the city and a private contractor, or by the applicant.

    (6)

    Copies of recorded easements obtained as required by the sewer main extension shall be attached to the application.

    (e)

    Before approval of said application, engineering drawings, plans and specification, must be completed by a Missouri Registered Professional Engineer. Said plans must be approved by the Missouri Department of Natural Resources, the city engineer, and any other state or federal agency or railway company having jurisdiction over the project. Applicant will be responsible for payment of all necessary permit fees or other fees, special insurance policies, or any other permit related costs required by any of the above agencies.

    (f)

    Where possible, all extensions of sewer mains shall be located in streets, roadways, alleys, or other easements existing in favor of the city. Where necessary, rights-of-way or easements shall be provided to the city at no cost to the city. All easements necessary to complete any sewer main extension shall be twenty (20) feet in width, be in favor of the city, be for the general installation of utilities, and be obtained prior to making application to the city for recoupment of costs for the extension. The costs of obtaining and recording all necessary easements shall be borne by the applicant, and may be added to the total project cost estimate, and shall be subject to recoupment.
