§ 21-115. Private driveways.

  • Private driveways shall be paved back from the curbing in the same manner as the gutters constructed in front of the property to be served by the driveway, rising to the sidewalk. The upper surface of the driveway from thence to the outside street line shall be made to conform to the grade of the sidewalk, and shall be paved with crushed stone, brick, asphalt, or concrete.

    (a)

    Any person desiring to construct or reconstruct any driveway shall, before commencing the work, apply to and obtain from the public works director a permit therefor, which permit shall be in writing, and shall specify a time within which said work shall be completed; and the driveway shall be constructed or reconstructed out of the materials, and in accordance with the plans and specifications prescribed by the ordinances of the city for the building of driveways, and constructed under the supervision of the public works director and streets commissioner.

    (b)

    Upon obtaining a permit as provided by this section, the person therein authorized to construct or reconstruct a driveway shall present the same to the public works director and streets commissioner, who shall inspect the construction or reconstruction of the driveway when the same is completed, according to the specifications therefor. The public works director and streets commissioner shall not approve any driveway which has not been built in accordance with the plans and specifications prescribed by the ordinances of the city.

    (c)

    If an application as submitted to the public works director under the provisions of this section shall be for work acceptable to and in conformity with this section, then the public works director is hereby authorized to issue a permit for such work upon the payment of the applicable fee as established in a schedule adopted by ordinance from time to time.
