§ 21-9. Obstructing sidewalks.

  • No person shall obstruct any public sidewalk in the City of Carthage or any area between any public sidewalk and any street in the City of Carthage by placing, causing or permitting to be placed thereon any object of any nature whatsoever. Provided, however, this provision shall not apply to any area properly marked and dedicated to public parking and further provided that this does not apply to any decorative lighting or any seating for the public, provided that such decorative lighting or seating for the public shall be approved by the city council prior to its placement. This section shall further not apply to sidewalks abutting commercial establishments within the Carthage Courthouse Square Historic District, wherein the commercial establishments may display certain wares and goods upon said sidewalk during daylight hours provided that said merchandise shall be displayed only on that five (5) feet of the sidewalk on the four (4) sides of the outside of the square closest to the mercantile establishment and provided further, that no more than twenty-four (24) inches of sidewalk be used or remaining sidewalks within said Carthage Courthouse Square Historic District.

    No person shall construct or maintain a downspout in such manner as to cause the water emitted therefrom to flow onto or across any sidewalk located in the City of Carthage.
